1. Overview
This Return and Refund Policy ("Policy") governs all purchases made through KaiMakesArt and is legally binding upon completion of any transaction. By placing an order, you acknowledge that you have read, understood, and agree to be bound by the terms set forth herein. This Policy is intended to comply with applicable United States federal and state consumer protection laws, including but not limited to the Federal Trade Commission's Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435).
KaiMakesArt reserves the right to modify this Policy at any time. The version in effect at the time of your purchase shall govern your transaction.
2. Manufacturing and Product Disclosure
KaiMakesArt sells a crocheted basket-style bag featuring a red floral design. Due to high demand, products that were previously handmade have transitioned to industrial manufacturing facilities. By communicating this transition in the present terms and conditions, KaiMakesArt is not responsible for claims based on expectations of handcrafted or artisanal product qualities. The customer, by completing a purchase, expressly accepts this condition and waives any claim based on artisanal or handmade expectations.
This disclosure constitutes adequate and legally sufficient notice under applicable consumer protection law.
3. Warranty Period
KaiMakesArt offers a 90-day limited warranty from the date of confirmed delivery. This warranty covers manufacturing defects only, as determined solely by KaiMakesArt upon inspection. It does not cover damage resulting from normal wear and tear, misuse, improper handling, unauthorized modifications, or cosmetic imperfections that do not affect the core functionality of the product.
Any return or refund request submitted after the 90-day warranty period has expired will be automatically denied, without exception.
4. Eligibility Requirements for Returns
To be eligible for a return, all of the following conditions must be met simultaneously. Failure to satisfy even one condition will render the return request ineligible:
- The return request must be submitted by email to knotsbykai@outlook.com within 7 calendar days of the delivery confirmation date.
- The item must be in its original, unopened condition, with all original packaging intact, seals unbroken, and tags attached.
- The item must not have been handled, used, tried on, altered, washed, or otherwise manipulated in any way.
- The item must be free of odors, stains, pet hair, and any evidence of use.
- The customer must provide photographic or video evidence of the item in its original, sealed condition prior to initiating the return shipment.
- The customer must retain proof of purchase (order confirmation email or order number).
- The return must be shipped within 5 calendar days of written return authorization issued by KaiMakesArt. Returns shipped without prior written authorization will be refused and returned to sender at the customer's expense.
5. Non-Returnable Items and Exclusions
The following circumstances are explicitly excluded from eligibility for return or refund, to the maximum extent permitted by applicable law:
- Items that have been opened, used, worn, washed, or removed from original packaging.
- Items returned without prior written authorization from KaiMakesArt.
- Items returned after the 7-calendar-day notice window has elapsed.
- Items damaged by the customer or through circumstances outside KaiMakesArt's control after delivery.
- Items purchased during promotional sales, flash sales, or discount events.
- Claims based on subjective dissatisfaction with color variation, texture, or aesthetic appearance, provided the item matches its general product description.
- Claims arising from the customer's expectation of a handmade or artisanal product, as disclosed in Section 2 of this Policy.
- Items for which the customer cannot provide the original proof of purchase.
- Any request submitted after the 90-day warranty period.
6. Return Shipping Costs
All return shipping costs are the sole responsibility of the customer. KaiMakesArt does not provide prepaid return labels, cover return postage, or reimburse shipping expenses under any circumstances.
The customer is responsible for:
- All outbound return shipping fees.
- Appropriate packaging to ensure the item arrives undamaged.
- Obtaining tracking and insurance for the return shipment.
KaiMakesArt is not responsible for return packages lost, stolen, or damaged in transit. Risk of loss for return shipments remains with the customer until the item is physically received and logged by KaiMakesArt.
7. Refund Process and Timeline
Upon physical receipt of the returned item, KaiMakesArt will conduct a complete inspection to verify that all eligibility conditions set forth in Section 4 are met. This inspection process may take up to 14 business days from the date of receipt.
KaiMakesArt reserves the sole and final discretion to determine whether a returned item meets all eligibility conditions. Items that fail inspection will not be refunded and will be returned to the customer at the customer's expense, or discarded if the customer declines to cover return shipping.
If the return is approved following inspection, a refund will be issued to the original payment method only, within up to 10 additional business days following approval. Total processing time from receipt of return to issuance of refund may therefore reach up to 24 business days.
Under no circumstances will original outbound shipping charges be refunded, regardless of the reason for the return.
8. Order Cancellations
Orders may be cancelled only before the order has been processed for fulfillment. Given that KaiMakesArt processes orders within 1 to 3 business days of placement, the cancellation window is extremely limited.
Once an order has been submitted to fulfillment or shipped, it cannot be cancelled under any circumstances. The customer must follow the standard return process upon receipt of the item.
Cancellation requests must be submitted by email to knotsbykai@outlook.com as soon as possible after order placement. KaiMakesArt does not guarantee that cancellation requests submitted within the processing window will be honored, as fulfillment may occur at any point within that period.
9. Shipping Delays and Delivery Timeframes
KaiMakesArt's standard delivery timeframe is 1 to 3 business days for order processing, followed by 13 to 20 business days for shipping and delivery. These timeframes are estimates only and are not guaranteed.
Shipping delays, whether caused by carrier delays, customs processing, weather events, holidays, force majeure events, or any other logistical circumstance beyond KaiMakesArt's control, do not constitute grounds for a refund, cancellation, or dispute. The customer expressly acknowledges and accepts this condition upon placing an order.
Refund or return eligibility is determined from the confirmed delivery date, not from the order placement date. If a package is delayed but ultimately delivered, the return window begins upon confirmed delivery.
In the event a package is confirmed lost by the carrier after a reasonable investigation period, KaiMakesArt will review the situation on a case-by-case basis and, at its sole discretion, may offer a replacement or store credit. No cash refund is guaranteed in such circumstances.
10. Chargebacks and Disputes
Initiating a chargeback or payment dispute with your financial institution without first contacting KaiMakesArt and following the return process outlined in this Policy constitutes a breach of this agreement. KaiMakesArt reserves the right to contest all chargebacks and provide relevant documentation to the payment processor, including this Policy, your order confirmation, and delivery confirmation records.
11. Limitation of Liability
To the fullest extent permitted by applicable United States law, KaiMakesArt's total liability to any customer shall not exceed the purchase price paid for the specific item in question. KaiMakesArt shall not be liable for any indirect, incidental, consequential, or punitive damages arising from a purchase, delay, or use of the product.
Nothing in this Policy limits rights that cannot be waived under applicable mandatory consumer protection law.
12. Consumer Rights Notice
This Policy is designed to comply with applicable federal law and the laws of the state in which the customer resides, to the extent required. Certain states provide consumers with additional statutory rights that cannot be contractually waived. Nothing in this Policy is intended to supersede or limit any right that applicable mandatory law grants to the consumer. If you believe your statutory consumer rights have been violated, you may contact your state's Attorney General office or consumer protection agency.
